Americans <u>don\u2019t want to see<\/u> data centers built in their area; <u>civil suits<\/u> are seeking damages from AI firms for supposedly <u>harming people\u2019s mental health<\/u>; and even Pope Leo XIV has <u>warned against<\/u> the technology.<\/p>\n<p>Read more <a href=\"https:\/\/officemovingamerica.com\/?p=260\">US Homeland Security Cancels Most Pending Noem-Era Contracts After Review<\/a><\/p>\n<\/div>\n<div>\n<p>Now you can add Florida to the list. On Monday it <u>became<\/u> the first state to sue OpenAI and its CEO, Sam Altman, over safety issues. The lawsuit is separate from <u>a criminal investigation<\/u> into the firm that the Sunshine State\u2019s attorney general, James Uthmeier, unveiled in April.<\/p>\n<\/div>\n<div>\n<p>In  filed in Florida circuit court, the state alleges OpenAI\u2019s growth is \u201cattributable to a web of deceit and the exploitation of users (including Floridians), leveraging their data and safety to boost OpenAI\u2019s market value at unacceptable costs.\u201d<\/p>\n<\/div>\n<div><\/div>\n<div>\n<p>Uthmeier also said he aims to hold Altman \u201cpersonally liable for the harm he has caused Floridians through his reckless and willful conduct as founder and CEO of OpenAI, including his utter disregard for the risk to human life caused by his firm\u2019s conduct.\u201d<\/p>\n<\/div>\n<div>\n<p>The complaint opens with a screenshot of ChatGPT\u2019s parental controls page, in which it says it is \u201ctrained to avoid showing harmful material.\u201d The first line of Florida\u2019s legal filing is simply: \u201cNot so.\u201d<\/p>\n<\/div>\n<div>\n<p>As I write this, the firm has not responded in court or with a public statement. OpenAI has denied wrongdoing in the mental health lawsuits and the criminal probe, which turns on how a Florida mass shooting suspect allegedly used ChatGPT to plan his attack on Florida State University.<\/p>\n<\/div>\n<div>\n<h2><b>A Possible Tobacco Precedent<\/b><\/h2>\n<\/div>\n<div>\n<p>We\u2019ve repeatedly noted in Decision Points that AI is here to stay and will revolutionize every area of human behavior \u2013 sometimes in frightening ways.<\/p>\n<\/div>\n<div>\n<p>(It\u2019s not the only tech to have hit a rough patch: Many states have gone after social media platform operators, alleging harm to minors\u2019 mental health.)<\/p>\n<p>Read more <a href=\"https:\/\/officemovingamerica.com\/?p=258\">Unconfirmed US Case of Flesh-Eating Screwworm Rattles Cattle Markets, Traders Say<\/a><\/p>\n<\/div>\n<div>\n<p>But one question raised by Florida\u2019s legal action is whether other states will follow suit, so to speak. Three decades ago, 46 states, five territories and Washington, D.C., reached a more than $200 billion settlement with the four largest tobacco companies to resolve lawsuits looking to recover government money spent to cover smoking-related illnesses.<\/p>\n<\/div>\n<div>\n<p>The complaint repeatedly refers to AI \u201caddiction,\u201d notably among minors. That\u2019s probably not by accident.<\/p>\n<\/div>\n<div>\n<p>\u201cMass shooters have been aided and abetted in deadly rampages, vulnerable people have been encouraged into suicide, professionals have suffered public humiliation, users have lost critical thinking skills, and minors have become addicted to a tool that feigns human compassion to collect their data with no parental oversight,\u201d it says in one spot. \u201cThis litany of harms is driven by Defendants\u2019 insatiable quest to win the AI arms race and amass large fortunes, despite knowing the danger of ChatGPT.\u201d<\/p>\n<\/div>\n<div><\/div>\n<div>\n<h2><b>Will This Slow Down AI?<\/b><\/h2>\n<\/div>\n<div>\n<p>The \u201carms race\u201d image is also important here. It\u2019s the term you hear regularly from AI boosters who say the real fear is not that we might develop sentient technology that <u>turns on us in deadly ways<\/u> but that China will beat us in the AI arms race.<\/p>\n<\/div>\n<div>\n<p>Opposition to data centers \u2013 the physical plants of AI \u2013 could conceivably slow down AI\u2019s growth. But even amid growing resistance and <u>health concerns<\/u>, their construction is <u>booming<\/u>. I\u2019m skeptical that this lawsuit by itself will meaningfully hamper the technology, though it might damage ChatGPT.<\/p>\n<\/div>\n<div>\n<p>And while some states have taken other steps to rein in AI, President Donald Trump\u2019s federal government has tried to <u>preempt state-level restrictions<\/u>, invoking competition from China.
